Competition Rules & Disclaimers
2012 PlayFirst Game Idea Competition Official Rules

1. Eligibility. You must be eighteen (18) years old as of May 15, 2012 to be eligible for the PlayFirst Game Idea Competition (“Contest”). You must be a U.S. resident as of May 15, 2012. Employees of PlayFirst and any immediate family members are ineligible to win.

2. Deadline. Your electronic application must be received by PlayFirst no later than May 27, 2012 at 11:59 p.m. PDT. PlayFirst’s computer is the official clock for this Contest.  You may submit as many Applications (defined below) as you’d like, but you are only eligible to win once for the duration of the Contest.

3. Application.  Applications will only be considered if they are complete and accurate. Only Applications submitted electronically will be considered.  The Application must be sent to the PlayFirst staff, (competitions@playfirst.com) and must consist of the following material (a completed application is referred to as “Application”):

• Name, Phone Number and Email.
• A description of your idea in an e-mail.  The more description (i.e., game mechanics, text, sample pictures, etc.), the higher the chance of being selected.

4. Criteria.  PlayFirst is looking for Applications that contain game ideas that are (a) creative, (b) unique, and (c) fun.  Ideas should be family friendly as consistent with the PlayFirst game branding.  The idea can be an entirely new idea or extensions to an already-existing PlayFirst game.

5. Judging and Selection.  PlayFirst intends to select a winner each month.  However, PlayFirst is not obligated to select a winner for a particular month and may select multiple winners for a particular month.

6. Submissions Policy.  You agree that your Application is submitted to us on a non-confidential basis.  You acknowledge that the Application that you submit to PlayFirst may be similar to other games that PlayFirst currently has in its possession or that we may develop or receive at a later date, and you agree that you will not assert any claim against PlayFirst or its customers in connection with any such similarities.  By submitting your application to us, where legal, you grant to PlayFirst (and agree to confirm such grant in writing upon request) (a) all right, title, and ownership to the Application and the game idea included in the Application, and (b) the right to use your name, picture, likeness, biographical information, and Application for advertising/promotional/trade purposes, and any and all rights to said use, without notice or further compensation.

7. Final Authority. PlayFirst is committed to ensure fairness and impartiality in the Contest. However, PlayFirst shall have the non-appealable final authority in the event of a dispute arising out of, or related to the Contest.

8. Conditions on Participation. No prize transfer. No prize substitution or cash equivalent except at sole discretion of PlayFirst, who reserves right due to prize unavailability for any reason to substitute prize with one of comparable or greater value. Winner is solely responsible for payment of taxes on prize and for all other expenses not specifically stated herein. The Contest winner must, upon request by PlayFirst, complete, sign and return an affidavit of eligibility, a liability release and, where lawful, a publicity release within seven (7) business days of the date on the documents.

9. Indemnification.  By participating, entrant releases and agrees to hold harmless PlayFirst, its advertising and promotion agencies, prize suppliers and other entities involved in the development, conduct or implementation of the Contest, and their respective directors, officers, employees, representatives and agents from any and all liability for any injuries, losses or damages of any kind to persons and property (including but not limited to personal injury and death) arising directly or indirectly, in whole or in part, from (a) the Application or (b) the receipt, acceptance, possession, use/misuse of the prize or participation in the Contest or any Contest-related activity.

10. Disclaimer.  PlayFirst makes no warranty, representation, or guarantee, express or implied, in fact or in law, relative to the use of any prize including, without limitation, its quality, merchantability or fitness for a particular purpose.

11. Limitations of Liability.  PlayFirst is not responsible for any incorrect or inaccurate information, whether caused by web site users, tampering, hacking, or by any of the equipment or programming associated with or utilized in the Contest.  Entrants agree not to knowingly damage or cause interruption of the Contest or prevent others from participating in the Contest.  If, for any reason, the Contest is not capable of running as planned by reason of, but not limited to, tampering, unauthorized intervention, fraud, technical failures, or any other causes which PlayFirst, in its sole opinion, deems could corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, PlayFirst reserves the right at its sole discretion to cancel, modify or suspend the Contest.  Should PlayFirst take such action, notice of same will be posted on the website.
